1. Parties and purpose
RecruitCrew is a trading name of Orbix Technologies Ltd, company number 16973554. These business-to-business terms are intended to govern a school’s use of RecruitCrew to publish supply shifts, receive responses from registered staff and administer bookings.
2. What RecruitCrew does
RecruitCrew lets schools post shifts and contact suitable registered staff directly. Whether RecruitCrew is an employment agency or employment business for statutory purposes must be confirmed by a solicitor before these terms are finalised. Nothing in this draft should be relied on as a final characterisation.
3. Staff pay and engagement
- The school agrees pay directly with the teacher or teaching assistant.
- The school pays the staff member directly. RecruitCrew does not receive, hold or transfer wages.
- RecruitCrew does not run payroll, deduct PAYE or National Insurance, or add a margin to the staff member’s pay.
- The school remains responsible for confirming the correct contractual, employment-status, payroll and tax arrangements.
4. Vetting and safeguarding
Before matching, RecruitCrew requires an Enhanced DBS check with a Children’s Barred List check, identity evidence and a right-to-work check. The precise verification workflow, evidence-sharing process and allocation of responsibilities require solicitor review. Schools remain responsible for their own safer-recruitment, safeguarding and Keeping Children Safe in Education duties, including deciding whether a person is suitable for a particular setting.
5. Bookings and availability
A posted shift is broadcast to staff who appear to match the role, location and availability. RecruitCrew does not guarantee that a shift will be accepted or filled. A school must review the information provided and keep appropriate contingency arrangements.
6. Subscription and overages
The school pays the monthly plan shown at purchase. The subscription covers platform access and the number of filled shifts included in that tier. Fair-use overage terms apply beyond the tier cap, but the final overage rate and notice process must be confirmed before these terms are published.
7. Cancellation
A school may cancel at any time. Cancellation takes effect at the end of the current billing month. The final refund position, suspension rights and treatment of active bookings must be confirmed by a solicitor before publication.
8. Support
Support is available by email Monday to Friday. We aim to reply within one business day. This is a response target, not a guaranteed service level, and urgent safeguarding matters must follow the school’s own safeguarding procedure.
9. Liability
The final limitations of liability, indemnities and insurance requirements remain to be drafted by a solicitor. Nothing will exclude liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
10. Data
Each party must handle personal data lawfully. The final agreement must define when each party acts as controller or processor, how safeguarding information is shared, and whether a separate data-sharing or processing agreement is required.
11. Governing law
The intended governing law is England and Wales. The jurisdiction and dispute-resolution wording require solicitor confirmation.
